A federal judge dismissed the indictment against a tiktok creator Who was shot by a federal agent in South Los Angeles.
In the order, U.S. District Judge Fernando M. Olgin dismissed the indictment, citing that the defendant was denied access to a lawyer while in custody and the government’s failure to comply with court deadlines, including releasing body camera footage of the incident.
Carlitos Richard Parias, known as Richard LA on social media, was shot in October along with a deputy US Marshal who was called by DHS. “Targeted enforcement traffic stop.”
Federal agents arrested Parias after accusing him of driving his car back and forth, hitting law enforcement cars, in which he was implicated. Authorities said Parias was trying to avoid immigration arrest.
During the confrontation, a federal agent fired a weapon that struck Parias in the elbow, a ricochet bullet struck a deputy U.S. marshal in the head, prosecutors said.
Parias’ attorney did not immediately respond to a request for comment.
